Mary Murphy Defaults On Nymphomaniac Suit

If Mary Murphy would like to make sure she is not known forever as the nymphomaniac who loves cocaine fueled sex, it probably would have been a good idea to not default on the lawsuit that accused her of it by her former manager. The So You Think You Can Dance judge had a default entered against her and her former manager was awarded about $250K  plus 10% of all Mary's future earnings. Her lawyers say they will move to set aside the default, but it is really unclear why nothing was ever done previously. Mary insists the complaint is false, but right now it is out there and staring at her and to have to pay 10% of your future earnings to a guy who called you a cokehead, kind of sucks so you would think she would have taken it more seriously.

Sounds like a contract dispute. He probably spouted juicy stuff so she wouldn't stall it in court.

Obviously, you are not really a lawyer, or else you would have relevant comments to make about a default judgment, the potential grounds for it to be set aside, and the likelihood of success. For example, was it filed where there was no personal jurisdiction over her? In a federal court as a diversity action where there is no diversity? Was she never served Etc.)

It isn't easy or prudent to allow a default judgment and then attack the judgment in a collateral action. Even if you do not have a good defense on the merits, you probably can settle for less than the default amount, and the settlement can then be confidential.

You know, when I first read this, I saw 'nymphomaniac' as 'necropheliac' (or however you spell it) for some reason. Wow, I'm glad my first glance was wrong!

Unless you watch the show, you have no idea who she is. So at least she would be remembered for something?
