Bengals Cheerleader Beats The Dirty

For the time being at least, former Cincinnati Bengals cheerleader and convicted sex offender, Sarah Jones has won her defamation suit against Nik Richie and the dirty.com. Jones claimed that two posts on the site defamed her. Specifically, one which alleged she had sex with every member of the Bengals and the other which alleged she had two STD's. She said those posts caused her mental anguish. They probably did. The underage kid she had sex with might need some therapy down the road too. A jury awarded Jones $338,000.

When Richie appeals the verdict, which he will, the award will probably be set aside. The Communications Decency Act is what Richie relied on during his case, and it says that comments from third parties that is published on sites is protected speech and that the publisher should not be held responsible. If this verdict were allowed to stand, then every single comment on every single website would have to be moderated or verified before allowing it to be posted.

Just once in my life I'd like to have an abdomen like that.

that's the beauty/horror of things like thedirty and 4chan. its just pure, unregulated, open commenting, from anyone.

flattens the playing field.

I don't believe that. Comments on sites are in a very different category from the main articles that are posted to the sites.

@figgy, ive always been slim but i REALLY want nice abs. i'm doing it through lots of core exercises, cardio, being vegan, eating smaller portions, and drinking only water (no soda, no juice, no alcohol)

great results after less than 2 weeks.

Yes, "the underage kid she had sex with might need some therapy down the road too", horny ness therapy for all the boners he is gonna have from then on remembering when he banged this hottie.

She sued for some comments in a forum by John Does unrelated to the page owners? And she has won? Judicial system is more fucked up than alec baldwin's mind.

All good ideas @TE Cruz. I am revving up to give up sugar for awhile, see how I feel and see what it does for my level of stomach fat. No matter HOW thin I've ever been, I'm an apple shape and if I gain an ounce it goes right to my belly. And boobs.

Bacon Ranch said...

No way a lawyer wrote this.
Absolutely no way.

That's not the crux of the case nor why she won.

But hey, the hits help the Emperor buy new clothes!

Kelly said...

Figgy I feel ya. I'm also an apple and never have and never will have a flat tummy. At least we have great legs and boobs as apples!

figgy said...

Exactly @Reno! My boobs are bodacious, my legs are like those of a teenager and my ass is spectacular. Just don't look between boobs and ass.

I do yoga, and this morning I only had time for a quick session, so I threw down a towel and did a few asanas naked. Oh boy. Doing shoulder stand naked and looking at that belly fat trying to reach down and say hi to my face very a very bad way to begin the day. Note to self: spandex yoga tops are your friend.

yep the no sugar, no carbs, working out 7 days a week, doing the lying down leg lifts, where you start with your legs at a 90 degree angle from your body and then slowly lower your legs to the floor, then repeat, that blasts belly fat.

Only reason a high school boy would need therapy after hitting that is because he never gonna get a piece as hot again.

FYI:

She's marrying the student she started sleeping with when she was teaching.

The Dirty put it all out there and now she's chasing nickels and dimes.

If this were a male teacher who slept with his underage student, I wonder how differently this case would be.

@figgy, etc-- Have you read Wheat Belly? I've heard it's really useful for those who have excess fat in their midsection. My personal trainer/dietician/best friend says that that type of weight placement is all about diet. No amount of crunches will burn belly fat because that's where your weight naturally wants to go. I've basically had the opposite problem. I'm a pear and I've always had a flat stomach, any weighy goes straight to my thighs, ass, and hips. I want thinner legs, and no matter how much I run or do squats etc, there's still fat there that I can't lose!

WBotW said...

Wheat Belly is a big pile of unsubstantiated bullshit, feeding off the gluten free fad, just like the low-fat and high protein hysterias. Yes, some people are sensitive, yes, some people have celiac disease. The claims the author makes are completely without scientific or medical back-up though.

Unknown said...

@figgy, it all depends on what suits you best. yes, low/no carbs will help.

however, being a vegan, my diet is now 40% carbs, 50% veggies, and then whatever protein i can get my hands on. all the of fiber is doing soooo much good for my body, and i can have sprite on my cheat days (i am doing a drug-free thing so no caffeine in addition to no alcohol)

im not sure how it would suit an apple shape, but any healthful change is bound to only bring positive results.

Jolene Jolene said...

WbotW--I'm just telling you what people have told me. I haven't read the book, but I do know people who have attempted to cut wheat from their diets and find carbs in other foods (quinoa, vegetables, etc) and they have lost weight, particularly that pesky belly fat. If people haven't had success losing weight with what they're doing, what's so wrong with trying something new? And I'm not even saying everyone should be gluten free or everyone is sensitive, I'm talking about the effect wheat and carbs have on your blood sugar level and therefore can hinder weight loss.

I'm not quite sure why you don't think this will be the crux of the appeal. Richie publishes 3rd party information and then gives his opinion on that third party commentary. The judge in this case specifically discounted the CDA and declined to use it as a basis for his judgement. Richie gets around defamation by only giving his OPINION on commentary written by others (opinion is protected speech) the judge basically said that Richie was responsible for defaming her because he published what someone else said.

If this stands, no one on the Internet will have a comment section anymore because the site owner would be responsible for what everyone says.

Also, as I and many others have said many times, just because you're a lawyer doesn't make you magically knowledgeable in any area outside your specialty. Outside of one class in constitutional or communications law and studying for the bar, enty (as a estate/probate lawyer) probably doesn't know anymore about that type of law than any given reader.

You wouldn't want a dermatologist doing brain surgery...lawyers are the same way.

Count Jerkula said...

Come on Lola. The person currently behind the Enty character is as likely to be a lawyer as I am to be Gloria Steinem.

Count Jerkula said...

P.S. Lola, if it stands that site owners are deemed responsible for 3rd party content, then do you think all the porn tube sites, file lockers, file sharing sites, YouTube, etc will be sued into shutting down?

Whole different ball game than killing a link after getting a DMCA take down notice.

Totally agree with WBotW. The many of us who struggle with weight do so because of crap food -- not because of carbs, not because of fat -- because of junk. Bodybuilders eat tons of carbs, but they eat good ones (oatmeal, fruits, veggies). Plenty of people eat fat and are thin/healthy. It's not the macronutrient itself. It's the junk version of it. You can eat fat, you can eat carbs. You can't eat garbage. Same goes for vegetarianism/veganism. Meat/animal products are not responsible for every bad health outcome. Vegetarianism/veganism can be very healthy diets. And if you abstain from animal products out of philosophy/compassion -- that's a different thing.

The diet industry continues to make HUGE amounts of $$ on all the fad stuff. In the 90's it was low fat. Then it was low carb. Then it was total calories/portion control/100 calorie snack packs. Now it's veganism & low carb/paleo/wheat belly. Any diet works because they get you off crap. It's like the stupid blood type diet. I do believe that (expensive) blood tests can help you root out whta your body is allergic/sensitive to (which by avoiding would help you be healthy). But there's no way that type O-positive blood is healthier eating X,Y,Z. People get healthier on those diets because the specific list of things to eat for your type doesn't include garbage. There's no Coke/Pizza/Snickers diet.

French people have it right. Eat good quality in-season fruits/veggies. Eat bread. Eat meat (if you don't have a problem with it philosophically). Eat dessert. Don't eat processed crap. Don't eat too much of anything. Relax and eat your meals slowly (if possible -- harder to do here in the US). Don't watch TV/surf the web while you eat. Don't get overfull. Drink water. Walk a lot.

It is NOT a fad. Gluten had ruined my life (unknowingly) for more than 40 YEARS. I have no idea if Wheat Belly is a good book or not but waking people up to why they are sick, tired, in pain, and SUFFERING is a good thing. If you are not well informed go to you tube. Listen to the doctors who understand this stuff. Peter Osborne gives intelligent short tutorials on the why's and wherefores.

As I have said many times, I was LITERALLY bedridden for two years, spent over $100K on doctors, nutritionists & healers, plus trying every healing nostrum & diet. Until I started juicing and getting gluten, grains, and processed food out of my diet NOTHING WORKED. Not ONE medical professional ever mentioned gluten. A nutritional health coach helped me try this out. It was and is and will be a long journey to regain my health-I am still quite sick-but I now have HOPE and a PATH to functioning again.

DO NOT TALK ABOUT SOMETHING YOU SEEM TO KNOW NOTHING ABOUT. Let people figure out their own healing path. I am FURIOUS it took so long to find my way out of this nightmare but I am recovering at last.

The feedback loop when I eat the wrong thing is now pretty much instantaneous and CLEAR. I look 20 years younger, lost 40 lbs on my first juice fast 2 years ago and have kept it off. There is no way to argue with success.

To the apples on this list-I am a pear, and I would say give the gluten/grain-free diet a try. Can't hurt and might forestall the diabetes that is more likely to occur for your body type. Best of luck to you!!

The food supply in North America is full of pesticides & GMO. It is very unhealthy. I agree that eating crap is a problem. But I had changed my diet numerous times, and ate extremely carefully, for the 15 years I was severely disabled with IBS, joint pain, etc. It wasn't until I took out ALLLLLL gluten, grains & processed foods that I got relief. The IBS, GERD, joint pain, and muscle spasms went away in DAYS. It was so obvious. And when I tried to cheat even a LITTLE (I am a food addict, it is very clear to me!) the pain & spasms & tummy aches come right back.

I am not saying my situation is like everyone else's. I just think we all should leave each other alone to EXPERIMENT if something is not right, not put each other down or poo poo a new-ish dietary approach.

I do not recommend anyone do what I did, but in case there are others suffering all their life, as I did, not knowing what is wrong & causing all the pain & misery, I feel it a DUTY to share my story and encourage people to keep trying to find what works for THEM. If my tale of woe & surprising recovery can help ONE PERSON stop suffering as I did, then GOOD!

One last point-the Gluten-Free LABELING trend seems to be a food supplier's fad and IS mostly a crock of crapola. Under the lack of supervision and guidelines they can label table salt 'gluten free', which is of no help.

A friend with NO MONEY kindly went and bought me some blueberry muffins full of all KINDS of toxic crap thinking he was being considerate and then he happily ate them while I cringed at the damage he was doing to himself. His health problems would probably be less serious if he could afford to eat simple nutritious food. It hurts to watch. But I can only say what I know and what I see for ME. He is in charge of his own choices. Even though I said several times that I cannot eat processed or packaged food, he could not 'grok' this point and spent money on a useless food resource.

It will take a long time (as it did for me-SLOW LEARNER!) for people to understand that the convenience of packaged foods is also a huge detriment to health & well being. And I knew this FOREVER but still did not fully comprehend the meaning and the implementation of 'gluten free'/'grain free'/'processed food free' for myself until I tried and failed for about a year. And I still insist on 'trying' and 'cheating' as if my body is gonna give me a pass. It won't . It doesn't . It can't . And I could not be more grateful for the unmistakable feedback it gives me.

Just because so many have this misunderstanding and I have already said too much so only those who wanna know will make it this far:

IT TAKES 30-90 DAYS TO CLEAR GLUTEN FROM THE INTESTINES. 'Cutting down', eating bread two days instead of seven, having a 'treat' once in a while, does not do the trick. My nutrition coach suggested to me: just give it 30 days. Try it out. So I trusted her enough to do so.

I had a massive reduction in stomach distress and severe, crippling joint pain in just two DAYS when I cut out the gluten entirely. We tried the Eat For Life program by Joel Fuhrman. Excellent if BORING!!

Funny how people here are more concerned with remedial weight loss than the fact that a child was violated. I shouldn't be surprised given some of the ignorance here. If the roles were reversed everyone would be spitting fire. Sexism goes both ways
