Katie Holmes Is Going To Answer The Who Is Suri's Daddy Question

Think of this like a Your Turn in a special time. Kind of like one of those very special episodes NBC used to do when they would make Friends an extra 8 minutes. Now all the shows do that to give them an extra one minute in the next half hour of programming and screw up your DVR. Remember when we used to love when NBC would take one of their many top ten hits and make them longer. Now no one even watches NBC. Yes, we watch The Voice but that's it. And ultimately who really cares about The Voice or X Factor or any of the talent shows. Tell me the last time any of them produced any kind of star. Even American Idol; who used to have a pretty good track record has failed to do much for their winner.

Anyway, Katie Holmes is going to give a deposition in the lawsuit Tom Cruise filed against In Touch where they claim he abandoned Suri. If you are lawyer on the other side and want to ask Katie Holmes any question, what are you going to ask? I know the very first question out of my mouth and the reason Tom doesn't want her to testify is who is Suri's father? Biological father. I also want to know timelines about when they met and she got pregnant. I'm going to want to know whether it was IVF or regular sex. I'm going to want to know every last tiny bit of everything about making that child and the thing is it is all relevant. All of it. If Tom has anything to hide this is where he is going to drop that suit in a second.

If you could ask Katie any question, what would it be?

Am I the only one who sees as much Tom in Suri as there is Katie? IDK how Suri was conceived, don't care, but she definitely looks like she has Mapother genes. I've never gotten the whole insistence that she isn't biologically Tom's kid.

I don't know why it matters whether Tom is her biological father or not. He's her father on the birth certificate which bestows certain rights and expectations. While I understand why lawyers would be curious (especially a magazine's), I don't think Suri's actual parentage has any bearing on this lawsuit.

Cruise and his lawyers have to know this is coming. If Holmes has been paid to say that Cruise is the biological father and that Suri was conceived by way of nookie, when one or both of these is false, then a blood test will be ordered. Cruise might very well be the biological father of Suri, but there is no way in Hell his dick has ever been inside Holmes' love canal. Likely she's going to say that Cruise knocked her up by way of a turkey baster, which might mean the Doctor gets called to depose. He'll be asked where the little swimmers came from. Maybe he's been bought off too. Cruise has 100s of millions of $$$. If anybody gets caught in a lie ... dun dun dun. This could get really interesting.

This happens to regular people every day in every court in the US. TC and KH and even Suri are not above the law. Again, the ability to let that which truly does not matter slide. Tom is an idiot.

The lawyers for the rag magazine never asked Tom if he was Suri's bio daughter. As slimy as some lawyers are I don't think they are going to ask that.

It is just about the story Tom abandoned Suri or not not if their DNA match.

This isn't a paternity action, it's a defamation suit. I guess Enty is assuming that the IT attorney will pursue this line of questioning because lack of biological connection supports an abandonment claim? I don't think TC would have to answer any questions regarding paternity without a court order. This is private information and I doubt a judge would find the probative value significant enough to outweight the privacy costs, specifically, the private life a CHILD compromised. TC's attorneys would object like crazy about the line of questioning and a judge would have to determine whether they would be answered. Arguably, this information could be sealed from public disclosure, but I just don't think it's relevant enough to justifiy the invasion of privacy. An action to rebut paternity of a father who is on the birth certificate and married to the mother at the time of birth is difficult to iniate. The courts have found a strong public interest in perserving the "family."

Hi disco!!! I'm still around, just mostly lurking now that I'm teaching full time. That takes up all my brain space - very little room for celebrity snark, I'm afraid. We're out on snow days right now - Friday, Monday, and Tuesday. Tomorrow ought to be wild and wooly - elementary schoolers out for three extra days, with snow and ice, this close to Christmas - oy vey!

Yea, just sounds like hot air... They can ask the questions but not necessarily get the answers if it does not pertain to the case, this is a defamation case not a paternity case.

It's nobody's business.

Didn't mean to single you out! And, sorry to come across as a know it all (this character flaw is why I limit my posting).

I guess this is kind of a touchy subject for me. I used assisted reproduction to have my child, so I get defensive when this type of information is brought up as entertaining gossip.

On the subject of gossip, I think we can agree that since we're on this site posting, we're all interested in information that is none of our business. Mea culpa.

I do think there should be limits, though. Like information involving children -- I was mortified by the blind concerning a mom who used donor egg and enty proclaiming that THIS WILLL BE REVEALED, giving no thought or concern to the child. Yeah, the mom's a skank, but what about the kid?

I agree that medical information should be off limits, too. But, rehab for drinking and drugging is medical info...so, should that go, too? Also, mental illness? Crazy shit stars do...should that go, too? Would there be anything left?

I guess I'm saying there are some gray lines, but this kind of thing upsets me.

What question would I ask Katie? Well, if she seemed friendly I would ask "Shaved, trimmed or natural? " it is getting chilly in NYC, so I could see her growing a winter bush.

If she seemed unfriendly, I would ask her if Tom would bang her in the ass and call her by a man's name?

The only thing we know for sure is that the COS helped Cruise find a wife some time before he got together with Holmes. I would expect that neither of them would want to say much publicly about their daughter, few parents would. We'll have to wait and see what happens.

@MISCH Somehow people seem to forget the circumstances of Suri's birth. So Katie went into hiding several months before the birth and had the home birth with all the medical equipment bought by Tom. Then they didn't show Suri until she appeared on the cover of the magazine (was it Vanity Fair?). They claimed she was 7 months old, but lots of people speculated that she looked older.

Personally, I see Mapother's genes in Suri, but that whole story is suspicious.

And does anyone else remember that Katie claimed she was a virgin? And If I remember correctly Tom said on Oprah that he is the luckiest man an earth, because his future wife is virgin. She claimed she was Catholic and wanted to wait until marriage. However, she had no problem with conceiving the baby (presumably with Tom) outside the marriage in just several months after they started dating. This all makes sense, if she was pregnant before they met.

I guess I would ask Katie why she got involved with Tom in the first place. She left him because she was concerned for her child, but wasn't she concerned going in? Was she really not informed beforehand? Did she not know that if you get Tom, you get Scientology? I'm sorry, but a quick cruise on the Internet would scare off even the dumbest person. Aliens; volcanoes? You're kidding me. That is when I first started questioning Tom's sanity or credibility. After I did a little research on the Internet, since I knew nothing about Scientology. I couldn't believe my eyes. I always had a feeling that Katie was pregnant beforehand, and felt like it would look better if she was with someone intending to get married: enter Tom. Suri looks just like Josh Hartnett to me.

Catsup I think you're wrong as a point of law. TC sued because the magazine impled that he had "abandoned" Suri. Therefore the magazine's lawyers have the right to examine his possible motivations for doing so. The question of whether he was motivated to abandon the child because he was not the biological father is highly relevant. As was the question of whether he "abandoned" the child due to his COS beliefs. I do agree that the court would seal the answer, to protect Suri, but the question would be allowed. Personally I don't think TC "abandoned" Suri, it was simply the unfortunate timing of an unexpected seperation/divorce co-incident with the previously scheduled shooting schedule for his film commitments.

Paternity has nothing to do with this case. Legally Tom is the father, period. However....I've always heard that the biological father is Toms cousin and Suri was conceived invitro with the cousins sperm.

I still wonder if Tom Cruise wasn't sterile and Tommy Davis didn't contribute some semen--they look a lot alike and are both Scientologists. That was a conspiracy theory at one point. Tommy Davis is one evil dude, and at the beck and call of David Miscavage.

Catsup, I don't know if this is relevant to your argument about paternity but Tom & Katie weren't married at the time Suri was born. I remember someone pointed that out in another post regarding theories on Tom Cruise's rights to see/contact Suri.

When did Katie ever claim she was a virgin in her relationship with Tom? She has pretty much said Joshua Jackson was her "first", and there were suggestions that she also had a miscarriage during her relationship with Chris Klein.

@D. Brown, I don't really disagree with you, except in that you've characterized this as a cut and dried situation. It's not. This is why judges preside over litigation - two sides present two different interpretations of the law. If I were TC's attorney, I would advise my client not to answer any questions regarding paternity. If I were IT's attorney, I would demand he answer. We'd head to court to have a judge rule on whether an answer could be compelled. If I were IT's attorney's, I'd argue pretty much you have written. If I TC's attorney, I would argue invasion of privacy and the dangerous precedent this could set. That it would be against public policy to require proof of paternity for parties to tort actions. Further, the danger of establishing that biology is a definitive characteristic of commitment to a child, threatens the very concept of adoption. Finally, that allowing such questions of a father, who is on the birth certificate, would have far reaching implications on a policy level.

@Nicola - surprisingly, yes, marital status does matter, because of the arcane way the paternity laws are written. Up until very recently, the spouse of the mother at the time of birth, was irrebuttably presumed to be that father of the child. That means, no proof could be offered (except maybe proof of sterility?) to rebut the presumption of paternity.

Since DNA, the law has changed, but it's still difficult to overcome. And, to bring a paternity action, one needs to have standing, ie, be an interested party, the real fathers, relatives of the real father, or the cockholded dad.

It's an interesting question whether a defendant in a lawsuit like this one is an interested party. Great law exam question.

And, whoever brought up Michael Jackson. The defendants'attorneys Jackson's family's lawsuit talked about raising paternity as an issue, but did not. I'm not sure if the court shut them down or if they decided it was a bad PR move.

One last thought, then I'll keep my mouth shut. The question could be asked and TC could answer, I am the biological father, then what? I think it would be really hard for the defendants to compel TC AND SURI to submit to a DNA test for a tort action. The same arguments would be presented. I just don't see a court ordering such an invasive test of a child under these circumstances.

I don't understand how questions about Suri's paternity are relevant or are likely to lead to the discovery of relevant evidence if the only factual issue in the case is whether he abandoned Suri. This is especially so in this case, where Cruise is asserting that he did not abandon her. (It would be relevant if he were claiming that it wasn't abandonment because she wasn't his.)

Not only could I see a judge disallowing such questions if the issue came up during the deposition, I could see Cruise's (or Holmes') lawyers seeking a ruling in limine (beforehand) against the asking of such questions, and I could see a judge sanctioning a lawyer for asking them.

Tom is such an idiot for pursuing this lawsuit. It's already brought him so much bad press and now his ex-wife is going to testify? Is it really worth it? If he's a good and involved dad, Suri will know that, and no one else should matter.

I always thought the real Dad was Josh Hartnett just cause she was living with him for nearly five months in NYC before she disappeared. Tom wanted the image rehab of a husband and Dad again, so he got himself a pregnant wholesome imaged girl. It all blew up in his over peeled face which makes me laugh!! Evil laugh.

Suri was born in a hospital, not a home birth. Suri was born down the hall from Brooke Shields daughter, Grier, in St. John's Hospital. The big deal was Brooke Shields having her baby the same day as Cruise, since he had criticised her for taking anti-depresents when she had post-partum deppression.

What makes this interesting is if she is under oath it would invalidate any NDA she signed before or during the divorce. Meaning she can't be financially punished for telling the truth. Whether Tom is, or is not her father, he's pretty much deserted her after the divorce. She got one magical Disney weekend with Daddy and then he took a powder for good. I do think he skypes with her but due to his religion he cannot see her on a regular basis, and that's because Katie is an SP and it literally makes Tom physically ill to be around her, her cooties may contaminate him due to his beliefs.
I don't see him winning this suit because he doesn't see Suri, and that is the basis of his suit that he didn't abandon the child, when it's clear he has abandoned her. Very odd situation and one that he can't see is a no win for him. Well nobody ever called Tom Cruise smart. This sort of proves that.
