Tom Cruise And Katie Holmes Split Six Months Before Divorce

According to court papers leaked to The National Enquirer, Tom Cruise and Katie Holmes state their marriage became broken back in February 2012. Also, it turns out their marriage was not legal until November 11, 2006, and not in the Italian ceremony which had taken place earlier that year. I can't remember when I first started writing that they had split, but they went from always being with Suri together to rarely being with her except for public events. I do still think Katie sandbagged Tom with the divorce and he probably thought they would work it out and work out some kind of payment which would keep them together, and I love that she sandbagged him. I love that she ran away and chose to walk away from all the luxuries he gave her to try and get control of her life again. I love that Katie Holmes is free. I wish that all people in her situation, no matter what the shackles are could run away and be free. Do you realize how happy she must be right now? She has her life and her kid and she has enough money to make sure Suri is taken care of while she tries to get some roles for herself to make sure she can have a solid future after Suri turns 18.

  1. Under NY divorce law, the relationship has to have been broken down irretrievably for at least six months before a divorce is granted.

They may have just agreed to back-date it.

  2. Yay Enty! I love that she is free too AND has primary custody of Suri. I wonder what she said to him to get that? Cuz you know Nicole didn't get that luxury.

  4. I agree with you Enty, but Katie is also fortunate to have money to do that and not look back. For us 'real world' folks it's never that easy.

  7. As long as she's out of that relationship and free, then she's good. Whatever she does now (and I'm sure there will be some missteps along the way) she'll be no worse for wear. Good for her.

  8. i believe that for divorcing in NY You need to be separated since several months and according to many sources Cruise was surprised by the divorce
all i will say is like for Depp and Paradis ,we didnt see them together in official events since several months and It never is a good sign

  9. I'm sure being out of an unhappy marriage must be a great feeling. Now Katie gets to stand entirely on her own two feet - she can succeed and fail based on her own brains and talent. Let's see how that goes.

  10. One more thing....is their divorce FINAL?! I realize they may have settled all financial/custodial matters, but is their divorce legally final?! If so, how on earth did that happen in weeks, when for the rest of us mere mortals we actually have to go through the court systems and follow their rules?!

  12. I really wished that she would have taken this opportunity to be the celebrity spokesperson for all women in a paid marriage who are bearding for blockbuster movie stars. Think of all the good she could do if she spoke on out on their behalf.

  13. @Ms Cool, now there's a tell all I'd read for sure!! If she needs an advance to write it, I'm sure we can collect enough to get things started!

  14. I thought it was commonly known they had a court house wedding in CA and the Italian wedding was just for show and more PR for Tom.

I have to say I didn't think Katie would walk away from the golden hand cuffs Tom had on her. Even though she has her own money she didn't have Tom Cruise level money and didn't go after it either. Making sure Suri is cared for is seperate and justified.

We only have so much time on this planet she chose happiness over money and red carpets. Good for her I say.

  15. @Silly Girl yes the divorce is final. The Judge signed off on it, once the Judge signs the divorce decree you are free. I will say for the NY Court system it was fast tracked. Most non-contested divorces with no kids takes about a year to go through the court system since it is so backed up.

  16. I agree with you Timebomb. I still applaud her and I think Tom was really surprised that she got away.

  17. Thanks, @timebob. Mine took just under six months, and it was completely non-contested and all assets, custody, etc, were divided well before the deadline. The system was what took so long. I was surprised theirs was as fast tracked as it was. Good for them, though!

  18. There is no way you are an attorney. It is widely known that if you are married abroad the marriage is not recognized in the states so most couples are married before or after the out of country ceremony.

Also, most of the "inside stories" posted as of Kate are straight from TMZ or Radar. What's the deal?

  19. @Silly Girl & timebob - my divorce took one month. I did all of the paperwork, filed it 6/26 (IIRC), and we were officially dissolved 7/21. Cost me $421.

  20. Good for you, @Amber! That's a crazy short time period. The judge asked me TWICE if I was sure I wanted the divorce since we seemed to get along so well. I almost broke down in tears when she said that. See, that was the whole problem. We were just FRIENDS. Our relationship is still the same today as it was during our ten year marriage. I'm remarried now, and that former relationship is still the same! Ugh. Looking back. Ugh. But, I do have a beautiful son, so it wasn't all bad....

  21. Silly Girl, I am always happy to hear stories of people whose lives are happy now after working through things. Good luck and congrats on getting things fixed! Everyone deserves love, I believe, even though it's hard to get the situation right sometimes.

  22. Their Italian party was definitely 11/18/06 - my son's birthday.

Whocaresnow12 - that is inaccurate. Most legal foreign marriages are recognized in the U.S. The problem is that many U.S. couples are not able to execute a legal foreign marriage, due to residency requirements, time constraints, etc. Italy and France are both very strict when it comes to "foreigners" marrying there. But if the marriage is legal in the foreign country, it is virtually always legal in the U.S.

  23. Enty, I don't know who you are or what your deal is but I ADORE the fact that you write stuff like this and have hopes like this for other people.
I wish more people were like you.

I also admire that you are a child advocate even if you don't mean to be. Please keep up the great site, thanks for having a good, conscientiousness heart esp for the smallest and the weakest ones who don't.

  24. @Silly Girl - I totally get that. My ex was a NICE guy. A total alcoholic, but NICE. And that's what you're supposed to look for, right? Someone who isn't mean to you? My current BF is nice to me, plus so much more. It's nice to feel fulfilled all around.

  25. I've always been surprised at how cheap-looking that photo is. NOT the dress (Katie looks great) but the weirdly obvious light on the wall? I have no idea what kind of wall that is--it may well be some 1500s stone or something--but it looks like someone hung crinkled gold foil and then put a spotlight on it. Bad lighting designer, and he/she must've cost a fortune! Weird.

  26. Cancan- that is not true. Most foreign marriages require US filing of docmentation to validate the marriage. A majority of the time a vigil service needs to be performed to fulfill the requirements.

  27. I thought the Italian wedding was in November, after a civil ceremony in the states.

  28. Whocaresnow12, you are just plain wrong. Please review the information from the U.S. State Dept.; they should be the final arbiter on this.

  29. Whocaresnow12: I'm an American citizen but I live in France. I got married in France and I had to go through hell to get all the documents (which are only valid for 3 months) in order to have the marriage validated in France and the US. US paperwork needs to have an apostille attached (a fancy word for a stupid stamp that costs a lot of money), all documents need to be translated, and you have to be a resident of France for at least 2 months (and have an electricity bill in your name) I believe. I am not sure about Italian law, but I'd reckon it is the same. My marriage is recognized in Europe, the US and probably Mars.

  30. Did anyone else, for a brief second, think Angelina Jolie just posted on a CDAN post? I did, I'll admit it. :)

  31. Aw, Silly Girl! It is a nickname I can't use anymore because she's so popular! :)

  32. And now, both she and I are free to marry each other. Joey, I mean, Katie, I am your man. I like women from northern Ohio, Catholic girls' high alumnae, and I don't mind if they are taller than I am. Centrally located between NY and DC, I would be willing to move to NYC if the place were nice.

  33. My dad was married in China, to a Chinese citizen. They live in the US and are legally married in the US.

  34. I am also convinced that this two month gap since Tom last saw Suri is partly or wholly due to Kate and Suri being labeled SPs - suppressive persons. I'd wager that he "can" see Suri some...but not much, with heavy auditing before and aft.

  36. So... They were legally married in the States a whole week before the Italian extravaganza, their marriage was perfectly legal, and Enty's is grasping at straws to bring it the page hits?
