This B list celebrity/former model married to a B list entertainer would love nothing more than to get a divorce from her cheating husband but she is holding out because the pre-nup gives her nothing but a tiny amount for child support. She is trying to line up a reality show for herself before she ends the marriage. Oh, and there have been suggestions that she has cheated once or twice too, but with women.

She can't get support from David for either of them, anyway, because he's not their father. Mohammed Hadid is their dad and is very much involved --- they have a son, also.

I thought you couldn't negotiate financial terms for kids in the prenup?
ReplyDeleteIf they are in CA then the child support provision in the prenup is not enforceable. By statute child support is determined by an algebraic formula. There is an exception for extraordinary high earners but that involves a support calculation that exceeds the needs of the child
ReplyDeleteExactly. Child support in CA is based on his income, her income (or imputed minimum wage or ability to earn if one party does not work) and visitation percentage. Both parties get credit for things like health insurance, other children, mandatory union dues or contributions towards retirement, etc. The Judge or Commissioner then plugs it into the program and the amount is calculated. The Judge has the option of deviating from the formula for a variety of reasons. I've seen pre-nups overturned alog with "go away and I will give you money" Stipulations as well. I have been working in the field since 1985 and child support has gone from a perceived unimportant "woman's issue" to a "Big Deal" in California.
Delete+1 You can't contract away child support in my state either, via prenup or any other agreement, because it's for the benefit of the child, not the parent.
