Tom Cruise and Katie Holmes are divorcing after five years of marriage, reports People magazine. I have been saying this for awhile. Glad to see Katie's rep finally confirming it.
I guess Katie got a shorter contract than Nicole did. Tom wanted to make sure that wife #3 wasn't going to get a whole lot in the way of settlement. Katie will only be relevant from now on in relation to Suri. Her career is toast.
Interesting. When the rumors started that they were getting involved, the Post ran a blind saying there was a contract, she had to stay w/him five years, and would get a fixed settlement. Darned if I can remember how much, but I remember thinking it was low - $10m?

I suspect the pre-nup already covers custody of Suri, so we won't see a custody battle. TC and the cult will get her, even though it seems like she is closer to her mom.
Paternity test won't matter, at least under CA law (and I presume they'll file in LA County). It's been two year. Tom is legally Suri's dad forever.
You can get a big clue as to how the custody battle will go from how little you've seen Suri with Tom in the past year. Daddy Holmes has used the separation to set it up for Katie to get a controlling edge in custody. If Tom wanted to fight about eventual custody and keeping the control to indoctrinate Suri into being a COS-bot, he would have started doing so a year ago. He's already conceded.
I get the feeling from the look on her face in recent photos that she will get EXACTLY what she wants - in other words, she has the goods on him, and her dad has negotiated an iron-clad contract. I would be shocked at a repeat of the Nicole Kidman scenario. Especially in light of all the embarrassment surrounding Travolta. How bad would it look to have their #1 poster boy keeping the kid from its natural mom?
Here's my take: Suri goes to Katie, however there's sure to be a Co$ clause in there somewhere that keeps Suri "protected" from the huddled masses (ie those who are dying to get any material for a DNA test). We know Katie filed the divorce docs in New York on June 28, citing "irreconcilable differences." She is asking for sole legal custody and "primary residential custody" of the couple's 6-year-old daughter, Suri.
We also know Katie is asking for a "suitable amount" of child support.
Katie also asks for a division of property in her divorce docs, although we know there was a significant prenup that is based on California law. Katie makes no mention of the prenup in her filing.
We're told Tom "did not see this coming." We're told there is some "nastiness" here, evidenced by Katie's move to get sole legal custody.

Even if her father may have negotiated her deal, I can't see how he'd be a match for the CoS big guns. And her asking for sole custody? Hmmm...not sure how that'd go over. It will be really interesting to see how this plays out.

I have doubts that KH actually filed (since it was filed anonymously, how would they know who actually filed?) and I could see the TMZ account being a plant to make Katie look like the bad guy, ditching TC out of nowhere and trying to take their daughter away. Last time TC was the one who filed for divorce from Nicole and I remember it being a big ole "he's a jerk and a liar!" thing where people pitied Nicole being blindsided. Maybe this time they want to make it look like KH has her own thing going on and is being the bad guy, and she'll eventually "compromise" on joint custody (at least for cameras) so he looks like the reasonable one. I could see her being willing to take the fall for the marriage ending in order to truly have full custody of her child.
Funny how non-gossip blog reading friends are surprised by this news. I think Julianne Hough will be the next Mrs. Cruise. Not quite 11 years younger, she's 10 years younger than Katie, but they can say they fell in love filming "Rock of Ages."
I think the contract might have been longer, but the public didn't love TomKat as a couple as much as it liked Tom and Nicole. Katie's career didn't get the boost she expected and she's still young enough that she can fall in love for real and have another family.

the COS probably okayed the divorce filing to take all celeb gossip/pap focus off of travolta and onto cruise. no one will ever get the official story of what happened until Katie croaks and her memoirs are published. she probably signed so many non disclosure agreements that her hand hurt. outlive katie and you will get the truth. suri will get to live with kate just like his other kids live with nic... it's for show and good press.
Maybe Katie threatened to have a DNA test done for Suri to reveal that Tom isn't the father. It won't matter much in the legal sense as someone above as pointed out, but it might cause issues for Tom's career/public image and the COS theology about Suri being the next incarnation of L-Ron. They don't like losing control over the message.

Asking for sole custody is standard practice in celebrity divorces. Don't make a big deal out of it.
Filing in New York state is an interesting move, but Tom will have good grounds for claiming CA as the legal residence of the family and getting the divorce case moved to LA. Plus the jurisdictional venue for the divorce is probably defined in the prenup. She likely filed in NY to get a good initial custody order. But the fight, if there is one, will be fought in LA.
I don't know what the paternity law is in NY, but I bet that the question of whether or not Tom is Suri's biological father will be irrelevant.

@Nina I definitely see your point, and it would be awesome if that happened. But the public not laughing at her doesn't pay her bills. I know that sounds cynical, but the long-term security of her payoff is probably as important to her as her daughter's safety. And with the CoS in the equation, safety is something to take seriously.
I don't see why so many people think that the DNA thing is such a great bargaining chip. Assuming that Tom isn't Suri's bio-dad, his people could easily spin it that he was misled by Katie is completely shocked and saddened by that. Then he'll be put on a higher pedestal and Katie gets to wear an "A" around for the rest of her life, getting blacklisted from everything. And as long as his name is on the birth certificate, I don't think anything else matters legally.
Trying to use the truth about Suri's actual parentage as blackmail will backfire. Think about it. Plenty of couples have fertility problems and have to resort to egg or sperm donors. Daddy Holmes could get a little leverage out of the threat of "accidentally" leaking the proof that Tom isn't Suri's biological father, but it's a relatively empty threat. However Suri came to be conceived, Tom is seen as a nominally good father to her and a nominally good father to his adopted kids.
Whatever gag order or NDA Tom had in the prenup will be difficult to enforce. Katie will keep relatively silent about Tom and COS not out of fear, but simply because slagging the other parent is not good for the child. I think we can divine from how the initial separation has played out that Tom does not have the leverage over Katie that he had over Nicole.

@Agent**It, if it was a done deal Katie wouldn't have filed for divorce in New York and wouldn't have filed for sole custody. Filing for sole custody is a strong sign of a contested divorce.
I think what we can glean from the past year and what's come out today is that they had some kind of negotiated separation agreement. One in which Tom was willing to let Suri live mostly with Katie and spend enough time in New York to make a nominal case for residency there--which is interesting because surely Tom's attorneys knew the legal ramifications of that. That Daddy Holmes also put together a blitzkrieg option is not surprising. What is interesting is that Katie & Co. have opted to go with it. They must think that they can get more out of a contested divorce than a negotiated one, and I'm guessing they're going for more freedom and security from Tom/COS backlash, not more money.
This also may be a practical move to make it clear to Tom that the marriage is over and the divorce is not going to be on his terms. He really does believe in all that Scieno superman bullshit, after all. Yes and no. Katie has enough money to have already retained the best family law counsel in New York (and likely California as well). Her legal team will be willing to represent her until the inevitable fees award starts sticking Tom with her legal bills.
It's the COS dirty tricks that Katie & Co. fear, not the above-board legal fight. Tom, IIRC, has resorted to the likes of Pellicano in the past.

Almost certainly. There are a number of legal reasons why, but the interesting practical reasons would be:
--The COS SS likely has the LA County judges and prominent family law counsel sussed out. It's one of their home turfs and they've got the infrastructure for a nasty legal fight there.
--New York family law courts probably would take a much more dim view of COS practices in terms of child custody fitness. The New York law and legal precedents with regard to the religious practices of a parent may be different in New York too. In California, in a joint custody situation either parent has a lot of latitude to force their religion upon the child. There's case law about just that.
I'm surprised that no one else has mentioned another part of the timing: Tom's 50th birthday is next week. Talk about being extra vulnerable. Three divorce filings at 49 years old? Yeesh.
A friend of mine once said she filed for divorce becuase she could not stand the thought of going to spend his birthday celebrating and pretending. She filed the week before is birthday. That was the catalyst for her.

Sad news. Going through a divorce is very difficult and affects much more than just the husband and wife. It is rough for the kids, step-kids, parents, extended family and friends. It's something I wouldn't wish on anyone. People that celebrate a divorce have either never been involved in one or have a heart of stone. I wish them peace and hope it is settled quickly.

Nina, if you think back, she DID work a LOT in high profile (or at least well publicized) projects in the first 2-3 years after they got married. In other words, she got the opportunities, but she couldn't turn that into A-list career because she really didn't have the talent or charisma. But her name recognition went WAY up.

I have doubts that KH actually filed (since it was filed anonymously, how would they know who actually filed?) and I could see the TMZ account being a plant to make Katie look like the bad guy, ditching TC out of nowhere and trying to take their daughter away. Last time TC was the one who filed for divorce from Nicole and I remember it being a big ole "he's a jerk and a liar!" thing where people pitied Nicole being blindsided. Maybe this time they want to make it look like KH has her own thing going on and is being the bad guy, and she'll eventually "compromise" on joint custody (at least for cameras) so he looks like the reasonable one. I could see her being willing to take the fall for the marriage ending in order to truly have full custody of her child.

the COS probably okayed the divorce filing to take all celeb gossip/pap focus off of travolta and onto cruise. no one will ever get the official story of what happened until Katie croaks and her memoirs are published. she probably signed so many non disclosure agreements that her hand hurt. outlive katie and you will get the truth. suri will get to live with kate just like his other kids live with nic... it's for show and good press.

It won't matter much in the legal sense as someone above as pointed out, but it might cause issues for Tom's career/public image and the COS theology about Suri being the next incarnation of L-Ron. They don't like losing control over the message.

ReplyDeleteAsking for sole custody is standard practice in celebrity divorces. Don't make a big deal out of it.
ReplyDeleteFiling in New York state is an interesting move, but Tom will have good grounds for claiming CA as the legal residence of the family and getting the divorce case moved to LA. Plus the jurisdictional venue for the divorce is probably defined in the prenup. She likely filed in NY to get a good initial custody order. But the fight, if there is one, will be fought in LA.
I don't know what the paternity law is in NY, but I bet that the question of whether or not Tom is Suri's biological father will be irrelevant.

@little miss smoke... I get that she will be in breach of contract - I'm just wondering doesn't that mean she just loses the $$? Daddy Holmes probably had the whole divorce package (filings prepared, counsel retained, etc.) ready in button-down mode, waiting for a time when Tom and his COS backers were vulnerable. Well, Rock of Ages just bombed, Scieno family royalty is fleeing like rats, Lisa Marie bailed and there are rumors that other COS celebs will follow, Travolta is in a huge mess...what better time to lever your daughter away from the clams?

ReplyDelete@Nina I definitely see your point, and it would be awesome if that happened. But the public not laughing at her doesn't pay her bills. I know that sounds cynical, but the long-term security of her payoff is probably as important to her as her daughter's safety. And with the CoS in the equation, safety is something to take seriously.

ReplyDeleteI don't see why so many people think that the DNA thing is such a great bargaining chip. Assuming that Tom isn't Suri's bio-dad, his people could easily spin it that he was misled by Katie is completely shocked and saddened by that. Then he'll be put on a higher pedestal and Katie gets to wear an "A" around for the rest of her life, getting blacklisted from everything. And as long as his name is on the birth certificate, I don't think anything else matters legally.

ReplyDeleteTrying to use the truth about Suri's actual parentage as blackmail will backfire. Think about it. Plenty of couples have fertility problems and have to resort to egg or sperm donors. Daddy Holmes could get a little leverage out of the threat of "accidentally" leaking the proof that Tom isn't Suri's biological father, but it's a relatively empty threat. However Suri came to be conceived, Tom is seen as a nominally good father to her and a nominally good father to his adopted kids.
ReplyDeleteWhatever gag order or NDA Tom had in the prenup will be difficult to enforce. Katie will keep relatively silent about Tom and COS not out of fear, but simply because slagging the other parent is not good for the child. I think we can divine from how the initial separation has played out that Tom does not have the leverage over Katie that he had over Nicole.

@Agent**It, if it was a done deal Katie wouldn't have filed for divorce in New York and wouldn't have filed for sole custody. Filing for sole custody is a strong sign of a contested divorce.
ReplyDeleteI think what we can glean from the past year and what's come out today is that they had some kind of negotiated separation agreement. One in which Tom was willing to let Suri live mostly with Katie and spend enough time in New York to make a nominal case for residency there--which is interesting because surely Tom's attorneys knew the legal ramifications of that. That Daddy Holmes also put together a blitzkrieg option is not surprising. What is interesting is that Katie & Co. have opted to go with it. They must think that they can get more out of a contested divorce than a negotiated one, and I'm guessing they're going for more freedom and security from Tom/COS backlash, not more money.
This also may be a practical move to make it clear to Tom that the marriage is over and the divorce is not going to be on his terms. He really does believe in all that Scieno superman bullshit, after all. He probably truly believed until today that he could "save" the marriage with his superior tech or control the outcome with is COS-powers.
Aaaaand the "dirt" on Katie should start showing up from mysterious (read: Co$) sources in 3...2...

ReplyDeleteYes and no. Katie has enough money to have already retained the best family law counsel in New York (and likely California as well). Her legal team will be willing to represent her until the inevitable fees award starts sticking Tom with her legal bills.
It's the COS dirty tricks that Katie & Co. fear, not the above-board legal fight. Tom, IIRC, has resorted to the likes of Pellicano in the past.

ReplyDeleteAlmost certainly. There are a number of legal reasons why, but the interesting practical reasons would be:
--The COS SS likely has the LA County judges and prominent family law counsel sussed out. It's one of their home turfs and they've got the infrastructure for a nasty legal fight there.
--New York family law courts probably would take a much more dim view of COS practices in terms of child custody fitness. The New York law and legal precedents with regard to the religious practices of a parent may be different in New York too. In California, in a joint custody situation either parent has a lot of latitude to force their religion upon the child. There's case law about just that.
I'm surprised that no one else has mentioned another part of the timing: Tom's 50th birthday is next week. Talk about being extra vulnerable. Three divorce filings at 49 years old? Yeesh.

About the DNA: If Katie threatened to tell the world that the REAMS of articles and quotes Tom gave about Suri's biological-ness were all fake, at minimum it turns off fans to be repeatedly lied to. At maximum, it gets the public talking about all faking fakers in Co$, and the non-internet (know-nothing) folks will start adding up the clues from Tom's entire faking life. Fans don't like being lied to over & over.

Sad news. Going through a divorce is very difficult and affects much more than just the husband and wife. It is rough for the kids, step-kids, parents, extended family and friends. It's something I wouldn't wish on anyone. People that celebrate a divorce have either never been involved in one or have a heart of stone. I wish them peace and hope it is settled quickly.
