I'm not a *trained* lawyer, @TLP, but I watch crime TV and read gossip forums, so I think I'm qualified to answer this. I believe that the closet case would sue the ex Wife, saying that they must have irrefutable proof to have claimed he's gay. It's sort of unlikely that hard proof does exist, so any soft proof would be carefully ridiculed and debunked.
@Alita: I am no attorney, though I would love to hear one speak on this and answer some questions.
