Four Days Until Lindsay Lohan Goes On Trial

I'm starting to get the feeling that all of the proposed plea deals that we kept seeing floating around the media were made by Dina Lohan or Lindsay Lohan's lawyer to try and get some kind of public backing that her lawyer would then take to the prosecutor or try to force the prosecutor into taking a deal which is beneficial to Lindsay. With all the people getting ready to testify against Lindsay starting on Monday, why should the prosecutors take a deal that does not involve jail time or lockdown rehab? It seems pretty clear that Lindsay should get convicted. That means jail time. That means a lot of jail time. I will say that in the past month she has been nice and quiet and in hiding. She could also be trying to earn as much money as she can every night with all of her friends. Oh, and after looking at the photo above doesn't she kind of look like Rebel Wilson in it? They should remake Twins. Not with Lindsay though. That would ruin it. Rebel and some other actress they put in a wig to look like her.

You know what? The California prison system is so desperately overcrowded that the state is under orders from a federal judge to let people go. Literally just release prisoners into the streets as the crowding constitutes illegal "cruel and unusual punishment."

So tell me, which gang-banger, armed robber, drug dealer, mugger or rapist do you want put on the street so you can enjoy some "Oh, how the mighty have fallen" schadenfreude at Lohan's expense. Yeah, she's a human train wreck. I get that. But it takes a genuine idiot to think that she should be in a California jail or prison. Save the cellspace for someone we actually need to be protected from.

@Leviathan's Phone, I'd rather that she get six months of rehab without any kind of day passes and whatnot. Where she has to be completely sober for the entire time.

At the very least, it would keep her off the roadways.

It's not that any of us want her to get worse treatment than robbers or rapists--it's that she has had essentially ZERO consequences for her actions and continues to break the law because she knows she'll get away with it. If she actually gets in real trouble once, she might try to curb her ways in the future to avoid getting sent to jail or rehab again.

Yes the prisons are overcrowded - but she skates through without punishment whereas the rest of us would get locked up (even if for a few hours/days). I hope she gets court ordered rehab for 90 days. It's not jail - but we all know that won't happen. The best possible outcome is a lengthy rehab stay....

I would rather non-violent drug offenders were released than Lindsay Lohan. Lilo driving around while drunk and entitled is a far greater threat to society than some guy smoking weed in his basement.

Or, what Karen said - lock-down rehab.

For those asking, this trial is re: the lying to cops case after she got in an accident while driving a Porsche on the PCH during filming of Liz & Dick. At one time there was talk that there was a water bottle filled with alcohol in the car, but I don't know what happened to that. Anyway, LiHo told the cops her assistant was driving.

I would love for her to lose her license--or do they do that in California? She has more than enough traffic related incidents that prove that she shouldn't be allowed to get behind the wheel of any vehicle ever again. I'd also like to see her be forced to go to a locked down rehab--somewhere where there is no paparazzi stalking her so there is no reason for her to be granted passes to walk the streets.

LiLo's a "non violent drug offender!" That's my point.

The reason she's had "zero consequences" isn't some special treatment she's received for being a celebrity, it's that, as a non-violent drug offender, she's not part of a category that gets held long-term in California. She's had exactly the same treatment from the courts and justice system that any other non-violent repeat drug offender gets.

Lilo is absolutely NOT a nonviolent drug offender. Driving drunk is considered a violent offense. There are so many times she could have killed somebody and she actually did hit somebody in a parking lot. Who knows what the real story was behind that, but with her track record I would not be surprised if it really happened the way he said it did.

Even after getting arrested as many times as she has and getting into as many wrecks as she has, she continues to get behind the wheel drunk off her ass and on who knows what drugs. That is not a nonviolent drug offender, that is somebody who doesn't give a shit in any way about the fact that she is putting anybody in her way in danger with a 2 ton weapon.

No, she's not. At this point, she's not a drug offender at all. She's going on trial for lying to a police officer. What she lied about isn't a charge, what she was doing before she lied isn't a charge.

That's all she can be jailed for, because it's all she can be tried for.

You want her jailed because you don't like her. However good your reasons for disliking her, that's not a reason to put someone in jail.

Jonathan, Lindsay has had 3 DUIs in her short lifetime. That is three violent crimes she committed and was convicted for but never served jail time for. So, yes, she is a violent criminal and needs to have some sort of consequence at some point in her life, otherwise she will end up killing somebody with a car.

I would much rather see the pot smokers and two-bit pot dealers let go. They are much, MUCH less dangerous than Lindsay Lohan.

Oh, and just to answer your other point. I am fully aware of what her charges are in this trial. And lying to a police officer is a felony. So, yes, lock her up. This is like the 5th or 6th felony she has committed and 3 of them were violent crimes (DUIs). Your criminal record does play a role in your sentencing and we all know that with all of the evidence against her that she will most likely be found guilty, so there will be a sentencing.

I believe she is also in violation of her probation from the jewelry theft. She can get the suspended sentence reinstated and get kicked off of probation and have to do do time on that. Well this is what happens to 'normal' people. I know because it has happened to me, in my past life.

And Jonathan, even though an ordinary person wouldn't go to jail on the individual charges, I think they might if a judge looked at the overall pattern of behavior. After all, didn't Cali invent the "three strikes" law? They are much harsher on repeat offenders.

@Jonathan, as I said before, her criminal record will play a part in her sentencing. If this were the first time she was in trouble with the law, or even the second or third, then no, I would say that she shouldn't get much of a punishment. However, this is her 5th or 6th time and three of her convictions were for violent crimes. Criminal records are always, always a consideration in sentencing. Not to mention that as somebody previously mention, this violates her probation. Add all of those things up and yes, she deserves to go to jail. As would anybody. It isn't just because she is star it is because she needs to face the consequences of her repeated criminal behavior that doesn't show any signs of stopping.

Maybe if CA actually deported all the illegal scum bags that are crowding their prisons they'd have room for Lindsay. But that will never happen, we've got to feed, clothe and house Mexico's garbage along with our own. They're just committing the crimes Americans won't commit, what vibrant new citizens we've got! Such diversity, they add so much to this salad bowl of a country!

@Mooshki - You're correct, as I understand it. If she is found to be guilty of lying to police, it will be a probation violation. I'm not sure if there are multiple charges or not. If so - maybe someone else can confirm - I think each charge would be a probation violation.

Can you just see the look on her face if they do make her go to jail like our patron saint RDJ? Oh wait, that saved his life. Hmmm....Sensing another pattern here.

To expand on what I and Annie have said:

Hitting someone with your car is violent.
Driving drunk is violent.
Assault is violent.

Testing positive for cocaine while you are on probation does mean you are a drug offender.

Theft and destroying property cause considerable harm in society.

Lying to police, violating probation, and failing to appear in court harms the integrity of our legal system, and that hurts us all.

This is not a case of someone convicted of mere possession of drugs. This is not a case of someone whose drug use has not caused harm. This is not a case of someone "making a mistake" once or twice or three or four times. This is a case of someone who routinely and habitually breaks the law and has already proved she refuses to atone for it or has any intention of stopping until society steps in and makes her stop.

Oh - and to address another of Jonathan's claims:

I don't dislike Lindsay. I think she's one of the saddest, most tragic cases of the harm Hollywood and a shitty family life can cause. I think she had real talent and was really rooting for her back in the Mean Girls days.

She has been given very, very, minimal things to do to "repay her dues," and she has absolutely refused to do it. How many times has she violated probation? Has she ever *not* violated her probation?

I want to see her face actual consequences for two reasons: 1) She has and will continue to harm society until she is stopped. 2) Being allowed to continue on her current path is, at this point, enabling her to harm society *and herself* and she needs to face real, actual, and appropriate consequences before she will ever clean herself up.

So, for the good of society and the good of Lindsay Lohan, lock her up.

I was in the camp that felt sorry for LL. Addiction is sad and no joke and her "parents" are a living nightmare. However, she is an adult who refuses to even entertain the notion that she ever does anything that is her fault/responsibility. There's only so much you can blame on a lousy childhood and addiction. If she showed the slightest bit of remorse and took even the slightest amount of blame, I could begin to feel for her again. Don't see that happening though. Throw the book at her.

And PLEASE don't insult Rebel like that. That is beyond offensive.

@Mango, may I politely disagree?. I like that Andrew presented his take on it in a calm and intelligent manner. Nothing wrong with a differing opinion especially when no one gets nasty or resorts to name calling. I must agree with Livia though that jail time could possibly save Liho's life. And it has nothing to do with like or dislike of Linds.

And one more post (because I'm all fired up) to address the actual overcrowding issue.

The argument that LL should be kept out of jail because of overcrowding was perfectly reasonable for any of the first THREE TIMES she was sent to jail and then let out early. At some point, it's just not OK anymore.

Unless CA is now housing male and female prisoners in the same cells, LL will only be competing for space with other female prisoners. This means there will be a significantly smaller proportion of violent criminals like murderers, rapists, and armed robbers. There must be at least a few women who are on their 1st, 2nd, or even 3rd conviction for things like non-violent drug possession, check forging, or misdemeanor theft. Let one of them out.

Because now?

Now with everything LL's done - the lying to police, the cocaine use and possession, the car wrecks, the DUIs, the assault, the theft, the destruction of property, the probation violations and missed court dates and THE HITTING SOMEONE WITH HER CAR-

Now with this being her, what are we even up to now? Her 5th? 6th? 7th? conviction of a serious crime-

Now it's LL's turn to park her ass in jail for awhile and let a woman with fewer convictions for lesser crimes get out.

And if that doesn't happen, if we let some lesser-convicted woman rot in prison while LL gets a little wrist-slap of probation (which she has already shown means NOTHING to her), you would have to be, to quote Leviathan, a real idiot to think justice was being applied fairly and LL isn't getting special treatment.

Amy Locane just got a bunch of jailtime for driving while wasted and killing a person. How long is it until Lindsay does the same?

That assault of that psychic in NYC is another one. I know that's not part of this trial, but again, what if she starts wailing on someone and seriously injures them, or kills them? (But in Lindsay's defense, the psychic really should have seen it coming...)

Or the thefts. What if, at some lady's house, she gets caught pocketing jewelry and attacks her when the woman calls the police?

Those are all what-ifs, but she's proven herself to be a violent, wasted-driving thief. She's going to hurt or kill somebody one of these days if she's not stopped now.

If the state of California can't afford to put her in prison maybe we can setup a Kickstarter to fund her entire sentence. We might raise enough to put her away for life. She's got to be flirting with the three strikes laws by now.
