Casey Aldridge Is A Lucky Man

You might think that the headline is a little misleading considering Casey Aldridge was in that terrible truck accident over the weekend, but with just a little bad luck he could have ended up like Nick Hogan. Casey was charged with careless operation of a motor vehicle, but if any of his four passengers had been killed in the accident he could be looking at serious jail time. Instead, through some kind of miracle, despite three people being ejected from the truck, he was the only one seriously hurt. Oh sure, he will probably get sued, but if his insurance won't pay up, then maybe Britney will lend him a few bucks.

The police said they didn't have any reason to suspect Casey was drinking and I don't either, but I do find it extremely interesting that no policeman actually talked to Casey until four hours after his crash and that is when they made their drinking determination. Ummm, like I said, I have no reason to suspect he was drinking, but doing an interview with him four hours after the fact is not going to give you the best indication as to whether he was under the influence of something.

I'm glad everyone is doing fine, and Casey should be grateful that this didn't turn out with him being the next Nick Hogan. By the way, how do you fit five people into that truck in the picture?

Seemed Like A Good Idea At The Time

That headline is probably going to be the first words out of the mouth of whatever guy they arrest from the Wal-Mart where Casey Aldridge took photos of Jamie Lynn Spears breast feeding her baby and holding the baby in some lingerie. Now, Casey, because he is a world class idiot decided to take photos of a bare breasted, underaged Jamie Lynn Spears to Wal-Mart because he couldn't afford the $100 for a printer which would have printed out the photos for him at home. Plus, I guess he wasn't content to just sit and stare at them on his PC or e-mail them to everyone he knew. Nope, he took them to Wal-Mart where some 18 year old kid took a look at the photos and probably decided he could make a buck selling them. He probably would have made a fortune except for one tiny problem. Since Jamie Lynn is under age, the photos of her bare breast could be considered child porn. There is also that pesky issue of copyright, but hey, he probably still would have got the money.

Now, everyone is going to blame the boy or boys for trying to sell the photos, and yes, she is a minor so they should be prosecuted, but hey, Casey is a dumb ass himself. First of all, what did he think would happen? And second, why was he getting prints made of a naked Jamie Lynn? Was he going to plaster them all over, or send them out as Christmas cards for his friends?

Now, the law is hazy when it comes to someone just breast feeding their child. However, if the boys at Wal-Mart are found guilty of any child porn charge, then there should also be a long look at Casey Aldridge. IF the photo is considered to be pornography, then Casey could be in trouble for distributing it or even possessing it because the law does not make any exceptions just because you may or may not be the father of the child seen in the photo breast feeding.

My guess is that the photo will not be considered child porn, that Wal-Mart will get sued by someone, and that the photo will see the light of day in the tabloids when Casey needs some money to buy a damn printer.

Kneepads Magazine Does It Again

All day yesterday I watched as more and more websites linked to People Magazine and their story that Jamie Lynn Spears was showing off her new engagement ring to friends in Louisiana and in Mississippi. Kneepads Magazine used sources for this story. Using sources is for when someone does not want to come forward and be the one identified as leaking the story. If Jamie Lynn Spears is really showing off her engagement ring and wearing it in public and telling people in two states all about it, then why are there "sources?"

Presumably Casey "I don't have a job, but can afford a diamond ring big enough to keep a Spears child happy" Aldridge must have told his friends and family about buying the ring for Jamie, and how he was going to ask her to marry him and all of the things associated with that. What is he 18 or 19? You think he did it all in secret, snuck up to Jamie's house at night, called her on his cell, to come to her bedroom window and tossed the ring up to her to catch?

I think what happened is that there were a spate of negative stories about Jamie and her partying a few weeks ago, and that last week people were talking about how Casey was dating other women. So, what is a family trying to do that wants all of this to seem legitimate? How about a call to Kneepads? In return for this story, People will probably get a special discount on the exclusive photos of Jamie Lynn's baby. Unless of course it is obvious that that the baby does not belong to Casey, in which case, they will borrow some blond hair blue eyed baby from the nursery in the hospital.

Does Casey Want More Money?

Although they are not even dating, the planted stories are beginning to emerge which say that Casey Aldridge doesn't want to date Jamie Lynn Spears anymore until she proves that he is the father. "[Casey] wants a paternity test. [He] doesn't want to be with her until he's sure that he's the father."

Of course, I don't think Casey wants to be with her at all unless he is getting paid some serious money to be with her. Even if the child were his, which we know it isn't, I don't think he really wants to spend the rest of his life with the potential train wreck of a Spears child.

These stories that are being released could be stories from the Jamie side of the family so that way they can start to soften the blow that Casey is not the dad, or they could be coming from Casey's side because he wants more money to pretend he is the dad.

Either way this should be fun for the next few months.

Louisiana Police Can't Count

Casey Aldridge's uncle went down to the Kentwood Sheriff's Department and provided documentation to show that Casey is just 18 years old, and not 19 as earlier reported, including by me. The sheriff's department in Kentwood, Louisiana confirmed that no complaint had been lodged against Spears' boyfriend and that "no criminal investigation is currently underway".

The lack of investigation appears to be valid in regards to any possible felony charges against Casey, BUT, unless Casey is declining in age daily, he should still be guilty of a misdemeanor in both Louisiana and California.

In Louisiana, the relevant portion of the penal code is:

Misdemeanor carnal knowledge of a juvenile is sexual intercourse with consent between someone age 17 to 19 and someone age 15 to 17 when the difference in their ages is greater than two years

Casey is at least two years older than Jamie Lynn Spears. His birthday is later than hers and 18-16 = 2 + the extra days. I guess that the investigating officer in Kentwood must be missing some fingers or toes.

In California, the relevant portion of the penal code is:

1. If the minor is less than three years younger than the defendant, the offense is a misdemeanor.

I'm not saying here that I agree that this should be a crime. What I am saying is that the law is a strict liability law, and that under the law, if applied equally to all people, Casey is guilty. Strict liability means basically that there is no excuse under the law. There doesn't have to be intent, and believing someone to be older than they actually are is no excuse. Strict Liability just says, if this happened, you are guilty. I'm sure there are plenty of guys who have been convicted of this sex crime who had sex under the exact same age difference as happened here. If Casey walks, don't you think they might be just a wee bit pissed.

Satutory Rape Ya'll

I know there must be a million articles about Jamie Lynn Spears and her pregnancy, but I haven't seen one mentioning that Jamie's 19 year old boyfriend was arrested for statutory rape. Actually he might be 20 by now, but I don't know for sure.

California Penal Code 261.5 (the statutory rape law) makes it illegal to have non-marital sex with a minor under three circumstances:

1. If the minor is less than three years younger than the defendant, the offense is a misdemeanor.

2. If the minor is more than three years younger than the defendant, the statutory rape offense may be charged as a misdemeanor or a felony, and punishment can be up to three years state prison.

3. If the defendant is 21 or over and the minor 16 or younger, the statutory rape offense may be charged as a misdemeanor or a felony, and punishment can be up to four years state prison.

Sexual intercourse means any penetration, no matter how slight, of the vagina or genitalia by the penis. Ejaculation is not required.

It is not a defense that the other person may have consented to the intercourse.

Under the law, a person becomes one year older as soon as the first minute of his or her birthday has begun.

I think we can safely presume that Casey Aldridge had sex with Jamie Lynn Spears. His own mom said it was true. The only question that needs answering is whether Casey is going to be charged with a misdemeanor or a felony. Of course I guess the police could just choose to ignore the law. I mean Jamie Lynn is famous, and everyone knows that the same law doesn't apply to famous people. We can't have Jamie's baby daddy sitting in jail while his baby is being born. That would be wrong. Kind of like when a 19 year or 20 year old guy can't find anyone to have sex with but a high school junior.

Now you may be asking yourself, "well what if they had sex back in Louisiana? Is the crime different? Maybe 19 year old guys can have sex with minors there."

That's a very good question. Let's look at the law in Louisiana.

"Felony carnal knowledge of a juvenile is sexual intercourse with consent between (1) someone age 19 or older and someone between age 12 and 17 or (2) someone age 17 or older and someone between age 12 and 15. Misdemeanor carnal knowledge of a juvenile is sexual intercourse with consent between someone age 17 to 19 and someone age 15 to 17 when the difference in their ages is greater than two years."

In Louisiana, Casey would be looking at serious jail time and sex offender status for life. Under the law he would be arrested and charged with a felony. For some reason though, I just don't think he is going to be charged. I think that everyone with the power of investigation or arrest will ignore this little tidbit and the authorities will instead go after some other poor guy who doesn't have OK and US Weekly in his speed dial. If you are not going to enforce the laws equally, then just don't have them.
