Lady GaGa Calls Perez Hilton A Stalker

Former besties, Lady GaGa and Perez Hilton now hate each other. A lot. As in a ton. In fact, it is so bad between them that Lady GaGa accused Perez Hilton of stalking her because he wanted to rent an apartment in the same building that she lives in NYC. She also said she would not be surprised if she ends up shot. Here is the part that is interesting. Lady did not just move into that apartment. She has lived there for quite sometime. In a response to the accusations that he was stalking her, Perez said he had no idea that Gaga lived in the building until after he saw the apartment. I find that really hard to believe. They used to talk to each other all the time and see each other all the time and traveled the world with each other and he had no idea which building she lived in?

The bad blood started prior to GaGa ending up in a wheelchair. When she was in the wheelchair, Perez sent her a text calling it karma. Hmm, interesting. Karma for what? I think she is afraid that Perez will spill the beans why she is in the chair. The problem with a gossip columnist who wants to be friends with celebrities is that you can't say anything about them that is not 100% positive or they will not want to be your friend. The more people you have as friends, the less you can write. You might as well just start publishing a tabloid and call yourself People.

Perez Hilton Offered $20M For His Site

I don't usually talk about the Holiday Inn guy, but Gawker obtained a copy of the letter of intent sent to Perez' lawyers. The site would be owned by Zack Taylor, who is Canadian and runs a gossip site that is always sending out press releases, Nic Richie, who runs thedirty.com and finally, the big money behind the bid is Avid Life who shelled out $20M for hotornot a couple of years ago.

So, the interesting thing behind all of this is that it appears that Perez would have to say bye bye to his site. The new owners just want to use the domain to forward it to their new gossip site. They are basically buying the 55 million weekly page views. Perez has other sites and other interests now so it will be interesting to see if he is willing to walk away for $20M.

If Perez wants to be a celebrity then he will need to take the heat when he dresses like absolute crap. This outfit doesn't match and doesn't fit. He gets his clothes for free. The least he could do is pick some ones that don't make him look like Kazoo from the Flinstones. If they are going to give away crap clothes, then go buy some. You make enough money. BTW, Kathy Griffin just looks pretty good. Not I want to sleep with her good, but would go over to her house and drink with her parents kind of good. Thanks to flynet for the pics.

Perez Interviewed By BBC --Article Linked To By--Anyone? Anyone? Bueller?

Actually it is a pretty good interview and Perez discusses his objectivity in relation to Paris Hilton and even hints at it some more when he talks about access and how it can be a hindrance. Unlike me, the BBC reporters can write well and do not just throw out softballs. It is worth five minutes of your time reading it and I don't want Perez to be the only site linked to it all day because no one wants that throwing a party and no one showed up kind of feeling.

I Guess That Jennifer Aniston Topless Photo was Real--aka Perez Sued Again

Being the biggest on the block and making your distaste known for Jennifer Aniston puts your head squarely on the chopping block when you post a photo she does not want posted. Although every gossip site published the photo from the film The Break-Up, and millions of people now have it on their hard drive, Perez will be footing the bill for everyone involved. Universal wants Perez to shop showing the image and also wants the US Marshals to confiscate the material.

See, the problem with the law is that it moves slowly. No one cares about the picture anymore because we have all seen it. Even if they take Perez's copy who is going to get all the rest of the copies from every guy and many ladies who downloaded it. No money damages were asked for in the complaint and I don't think Universal will ask for any because Perez will make their lives miserable. It is interesting that Ms. Aniston did not actually file suit, unlike in the last topless action, but let the studio handle it instead.

Finally, the studio attached a copy of the photo(sans good parts) to the complaint, so now fair use would apply when publishing the photo (sans good parts) in the future.

Forbes has released their Web Celeb 25. This is their list of the 25 most influential people on the web today. According to Forbes it seems as if Perez has found himself doing number 2. Seriously though, whether you love him or hate him, everyone reads him or it least seems that way. I guess I am a complete moron because I only recognize about 6 of the names on the list. Isn't the idea that they are supposed to be the biggest web celebs and therefore the names should be fairly easy to recall.

November 4, 2006 - Heard the most awful sound in the house today. Turns out it was one of the cooks humming "Wannabe." He was flogged and then dismissed. Help is so hard to find these days.



November 19, 2006 - Was forced to spend five minutes with the children today. I do not know why I ever let David talk me into buying them. There is so much more I could do with the money.



December 18, 2006 - I heard about Melanie and Eddie Murphy and almost smiled for the first time in five years. I think the effort though ruptured a stitch somewhere.



December 25, 2006 - David slapped my tits for hours, but I won the bet we had. They did not even move an inch although I did have to sew back on one of the fake nipples.



January 12, 2007 - So David is going to play in LA. When I raised my one eyebrow that can still move to show my indifference or displeasure, he told me he is going to be the highest paid athlete in history. I told him that I still do not think he has anything to be proud of until he catches that Harry Potter woman. I mean she was homeless for gods sakes.



January 19, 2007 - Saw Katie and Tom. Katie and I went shopping. She i becoming so good at the always looking depressed look. I am so proud of her. I get along well with her as she does not mention Spice Girls and I do not mention Dawson's Creek. Tom tried to get us to involved with his church. I told him we would not get involved in any religion. If anyone is going to take half of David's money, it is going to be me.

Copyright infringement is very tricky because the US Constitution protects both copyright and freedom of speech. Therefore, when the two collide it can be complicated.

The balance is such that the Constitution wants to protect the artist (X17) but at the same time wants to limit their copyright because the works (photos) themselves may be useful to the public.

Perez's defense will be "fair use."

Once X17 has proved they own the copyright, the burden will shift to Perez to prove fair use which involves four factors the court looks at.

1. The first factor is the purpose and character of the use. If the use is commercial in nature, then you are less likely to prevail than if it is for non-profit. If you are using the pics to try and get profit, you may be in trouble, but if profit is incidental, then you may be ok. Further, if you just use a thumbnail rather than the entire photo, you are likely to be ok. Perez will have a tough time with this factor.

2. The second factor is the nature of the work - Is the work unique or is it fact? In this case, I would argue it is more fact than artistic and so would be in Perez's favor.

3. The third factor is the portion of the copyright used. So, if for example it was a group photo and you cropped all but one, you are more likely to prevail. This factor is a tossup

4. The fourth and most important factor is how the posting affected X17. If x17 can prove they were damaged by a reduction in sales or a the number of visitors to their site, then they would prevail. The numbers need to be real and verifiable and not just guesswork.

If the facts are true as reported in the press release, and they may not be, then X17 has a strong case.
