My husband's whore dumped her kids with their respective fathers when she moved in with my husband. My husband told her he didn't want little kids around. (Our kids are late teens.)

Sean Penn is a rich dude that doesn't want his style cramped. I doubt he'd make an ultimatum, but he simply wouldn't come around while the kid was around. Ergo, ditch the kid.
